Under section 139(1)(d) and (e) the holder of a casino licence (casino operator’s or casino venue licence) may apply and the Secretary may request to have the conditions of a casino licence specified, varied or revoked. The Gambling Commission must treat such applications in accordance with section 140.

Section 139(1) also sets out a number of other situations in which the Gambling Commission may specify, vary or revoke the conditions of a casino licence. These situations are covered by the flow diagrams for other processes.

Casino licence holder applies using the specified form to have the conditions of its licence specified, varied or revoked and pays the fee of $1,022.22 to the Commission
Secretary of the DIA requests that the Commission specifies, varies or revokes the conditions of a casino licence using the specified form
Commission determines it wishes to specify, vary or revoke conditions of a casino licence holder’s licence on its own initiative
Commission:
  • Identifies from the application by the licence holder or the request of the Secretary, or from any further inquiries, whether there are any persons potentially affected by the application/request (s140(1)).
  • Decides if it will appoint any experts to assist in its decision making.
Commission notifies Secretary, licence holder and any affected persons of the proposed specification, variation, or revocation of the conditions and the procedure to be followed

The procedure to be followed is that the licence holder, the Secretary and any other person affected may make written submissions to the Commission concerning the proposal within 20 working days or within any longer period that the Commission allows (s140(3)).
The Commission receives written submissions from the licence holder, the Secretary and affected persons
The Commission considers any submissions made and may, if it considers appropriate, seek comment from the licence holder on the submissions received from the Secretary and affected persons (s140(4))
Commission considers the factors in s139(2) and makes a decision
Commission notifies the licence holder, the Secretary and the affected persons of the decision, giving reasons and setting out the rights of appeal under s235 (s140(5))
