Orders to Remove or Circumvent Significant Influence in a Casino of an Associated Person


Under section 156(2) the Gambling Commission may require a person who is refused status as an associated person or whose status as an associated person is revoked, and the relevant casino licence holder, to organise themselves to remove or circumvent the significant influence in the casino of the person.

Secretary notifies the Commission that the circumstances set out in s156(1) exist

The Secretary should indicate how long the Secretary considers the licence holder should be given to reorganise itself.
The Commission determines that the circumstances set out in s156(1) exist
Chief Gambling Commissioner decides who is to be part of the Division to deal with the matter
If the Secretary has not yet done so, Division seeks an indication from the Secretary as to how long the licence holder should be given to reorganise itself
Division notifies the licence holder of the Secretary’s suggested compliance timeframe and Division requests details from the licence holder as to how long it considers it requires to comply with the notice
Licence holder notifies the Commission of how long it considers it requires to comply with a notice to reorganise
Division notifies the Secretary of the licence holder’s position, if necessary, and Secretary makes any response
Division requires the licence holder to reorganise itself to remove or circumvent the significant influence in the casino of the person within a set period
A copy of this notice should be sent to the Secretary
If the licence holder does not comply with the notice, the Secretary may apply for suspension or cancellation of the casino licence (s144)
